The Nature and Function of Soviet Justice

Project Summary

Examines Soviet law using conventional legal sources as well as émigré lawyers to probe whether two systems of justice exist in the USSR (one for societal deviants, the other for civil concerns) and whether the political status of the defendant and his utility to the Sovet state determines his treatment. Notes an unrecognized continuity between the justice system of the Stalinist and post-Stalinist periods.
